1. Introduction

Welcome to DexaFit Fairhope, an affiliate of DexaFit Health, LLC. We offer testing services, a website and software applications known as DexaFit and DexaFit AI ("the App"), providing a comprehensive wellness service. Our services enable members ("Members") to access laboratory diagnostics, report health histories, review health results and body scans, and engage healthcare providers ("Authorized Providers") for wellness-oriented healthcare advice ("the Service"). The App provides detailed information about our Service. We prioritize your privacy, and this Privacy Policy details how we collect, use, and disclose information about you when using the App or Services, whether you're a Member, Authorized Provider, or a Visitor to our App.

Definitions: "Personal Information" refers to data that personally identifies you, like your contact details and other non-public information linked to these details. "De-Identified Information" means information that cannot be used to personally identify an individual. For any questions about this Privacy Policy, please email us at support@dexafit.com.

Note for Beta Users: Beta users of the Service are subject to additional personal information provisions as outlined in the beta agreement with DexaFit.

2. How We Collect Your Information

Member Information includes data provided by Members when registering, scheduling appointments, or communicating through our App. This encompasses Health Information, Personal Information, Demographic Information, and Lifestyle Information. We also obtain information from Authorized Providers and Testing Laboratories, with proper authorization, and create De-Identified Information by removing personal identifiers.

Authorized Provider Information is collected when Authorized Providers register, communicate through our App, or participate in surveys. This includes their Personal Information and verification of credentials.

Visitor Information is collected from Visitors interacting with our App or emailing us. This includes Personal Information and App Activity Information, which could be either Personal Information or Anonymous Information.

3. How We Use Your Information

Member Information is used to administer accounts, process payments, provide the Service, tailor App features, market our Service and third-party services, handle requests, improve the App, and communicate about the Service. We also provide personalized advice, compare metrics to similar users, and conduct research with De-Identified Information.

Authorized Provider Information helps us administer accounts, verify identities, provide the Service to Members, handle requests, and improve the App.

Visitor Information is used for marketing, handling requests, improving the App, and communicating about the Service.

Anonymous and De-Identified Information are used to enhance the App, improve internal operations, notify Visitors about updates, and improve content and advertising.

4. How We Share Your Information

We share your information with third parties when we believe the sharing is permitted by you, reasonably necessary to offer our services, or when legally required to do so. For example, we may disclose certain Member Information, Health Provider Information and Visitor Information:

  • To third party vendors who help us provide the Service or the App or who provide additional goods and services through the App, including without limitation, testing laboratories, phlebotomists, billing providers and benefits administrators;

  • To third parties to whom you ask us to send such information;

  • To a third party such as a third party administrator, benefits provider or other organization in accordance with the terms of the program to which the Member is subject;

  • To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "Affiliates"), in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;

  • To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process the Member Information and Personal Information of Authorized Providers and Visitors as set forth in this Privacy Policy; or

  • If we believe in good faith that such disclosure is necessary to (i) resolve disputes, investigate problems, or enforce our Terms of Service; (ii) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (iii) protect and defend our rights or property or the rights and property of you or third parties.

Additionally, we will disclose Member Information to such Member's Authorized Provider in order to assist the Authorized Provider provide wellness-oriented healthcare advice to such Member. We also may disclose Anonymous Information and De-Identified Information publicly without restriction.

5. Information You Share With Third Parties

This Privacy Policy addresses our use and disclosure of information we collect from and/or about you on the App or through the Service. Information made available through the Service to Authorized Providers and testing laboratories is required to be used by such entities in accordance with all applicable laws, including the Health Insurance Portability and Accountability Act ("HIPAA"). If you disclose information to others, including, for example, a partner providing goods and services, different rules may apply to their use or disclosure of the information you disclose to them. The use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

When you click on links on the App you may leave our App. We are not responsible for the privacy practices of other Apps, and we encourage you to read their privacy statements.

6. Changing or Removing Your Information

Members and Authorized Providers can update some information through the App when available, or by emailing support@dexafit.com. We can't modify Visitor Information or Member Information without consent. Requests for deletion of Personal Information will be honored unless legal requirements dictate otherwise.

7. Protecting Your Information

We adhere to HIPAA and HITECH requirements for protecting your Personal Health Information (PHI), employing robust physical, electronic, and managerial security methods. Despite our efforts, no internet transmission is completely secure. Report any security violations to support@dexafit.com.

8. Uses and Disclosures of PHI

We use and disclose PHI for medical treatment, billing, healthcare operations, communication about products and services, and as required by law. We also use PHI for health oversight activities, research, product development, legal proceedings, law enforcement purposes, and public health activities, among others.

9. Your Rights Regarding Medical Information

As a DexaFit member, you have rights regarding your PHI, including access to and correction of your information, requesting restrictions on use and disclosures, and accounting for disclosures. Contact us to exercise these rights.

10. Children's Policy

Our Service is not directed to children under the age of 13, if you are not 13 years or older, do not use our Service without parental consent. We do not knowingly collect Personal Information from children under the age of 13. If we learn that Personal Information of persons less than 13 years-of-age has been collected through our Service without parent consent, we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child or a minor under the age of 13 has posted, submitted or otherwise communicated

Personal Information to our Service without your consent, then you may alert us at legal@dexafit.com so that we may take appropriate action to remove the minor’s Personal Information from our systems.

All minors under the age of 18 are required to submit parental consent in order to use the Services. Parents or guardians wishing to provide consent for a minor to use the App may contact us at support@dexafit.com to request the necessary paperwork.

11. California and European Privacy Rights

California residents can request a yearly report of third parties receiving their Personal Information for marketing. EU residents have specific rights under data protection laws regarding their Personal Information.

12. Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy. Any changes will be posted on our page, and we'll notify you via email if you've provided one.
